1. Refund Policy

All sales are final due to the custom and creative nature of our digital services. No refunds will be issued for:

  • Change of mind

  • Client delay or abandonment of project

  • Dissatisfaction after assets have been delivered or work has begun

Refunds are only considered if:

  • The project has not started, AND

  • The client contacts us in writing within 24 hours of payment.

2. Contract Policy

Each project requires a legally binding digital services agreement to be signed before work begins. This contract outlines:

  • Scope of work

  • Payment terms

  • Deadlines and client responsibilities

  • Intellectual property rights

  • Revision limitations

  • Termination and refund conditions

Clients who break the terms of their signed agreement (e.g., failing to pay, refusing communication, violating usage rights, etc.) will be considered in breach of contract, and Black Dahlia Design Co. reserves the right to pursue full legal action for damages, unpaid balances, and recovery of legal fees.

3. Dispute & Chargeback Policy

If you experience an issue with our service, you are required to contact us directly before filing a dispute with your payment provider.

Filing a fraudulent chargeback or false dispute after receiving services is a direct breach of contract and constitutes theft of services.

In such cases:

  • We will submit all documentation, signed agreements, email records, and evidence to dispute your claim.

  • We will pursue civil legal action for theft of services, breach of contract, and defamation if applicable.

  • You will be liable for all legal costs, processing fees, and recovery fees incurred.

By purchasing from us, you agree that you waive the right to reverse or dispute valid charges for services already rendered.

4. Unpaid Invoices & Abandonment Policy

All invoices are due according to the terms outlined in the contract. Late payments are subject to a $35 late fee per week, starting 7 days after the due date.

If an invoice remains unpaid for 30+ days:

  • We reserve the right to pause all current work and withhold access to deliverables.

  • The client forfeits any claim to completed or in-progress work.

  • We reserve the right to send unpaid balances to collections or file in small claims or civil court.

  • We may publicly blacklist or refuse future work with the client

If a project is abandoned by the client (lack of response for 21+ days), it will be archived and billed based on completed hours. No refunds will be given.

5. Legal Action & Enforcement Policy

We take our business, time, and creative labor seriously.

We reserve the right to pursue legal action in the following cases:

  • Breach of contract

  • Non-payment or chargeback of completed services

  • Fraudulent claims or defamation

  • Misuse or theft of delivered intellectual property

Clients engaging in fraudulent activity will be liable for:

  • The total amount owed

  • All attorney fees

  • Filing and court costs

  • Interest and penalties

Legal proceedings will be filed in the jurisdiction of St. Tammany Parish, Louisiana or any applicable court we choose.

6. Intellectual Property Policy

Ownership of final digital assets will only transfer to the client after all invoices are paid in full. Until that point, Black Dahlia Design Co. retains full copyright and usage rights.

Client use of unpaid or unauthorized assets will be considered IP theft, and we reserve the right to pursue takedown actions and legal damages.

7. Terms of Service

By using this site or hiring us, you agree to:

  • Provide all necessary information and assets in a timely manner

  • Respect timelines, feedback requests, and communication

  • Not engage in unethical, fraudulent, or threatening behavior

Violations of these terms may result in project cancellation with no refund, legal reporting, and pursuit of damages.

8. Privacy Policy

We collect minimal client information necessary to provide our services, including name, email, phone number, business details, and payment data.

We do not sell or share your information. Data is stored securely and only used to:

  • Communicate project progress

  • Invoice and fulfill legal tax obligations

  • Improve services

You may request access or deletion of your data at any time.

9. Disclaimer

We provide services to the best of our ability and with professional integrity. However, due to the nature of the digital landscape, we do not guarantee:

  • Specific search engine rankings

  • Sales increases

  • Social media performance

External factors (client behavior, platforms, algorithms, economy) are outside our control.
